Common types of theft offenses in Pennsylvania
There were 155,538 theft crime prosecutions in Pennsylvania in 2024, constituting more than half of total criminal cases in the state for that year. The term larceny is used informally to describe theft crimes, but it does not appear in Pennsylvania’s statutes.

Penalties for theft convictions in Pennsylvania
Theft crimes are categorized in general by the value of the property involved. The following is a summary of crimes and their respective punishments:
- Misdemeanor theft, third degree — For property valued under $50, up to one year in custody and a fine of up to $2,500.
- Misdemeanor theft, second degree — For property valued between $50 and $200, up to two years in jail and a fine of up to $5,000.
- Misdemeanor theft, first degree — For property valued between $200 to $1,000, up to five years in prison and fines of up to $10,000.
- Felony theft, third degree — For property valued between $2,000 and $100,000, up to seven years in prison and fines of up to $15,000.
- Felony theft, second degree — For property valued between $100,000 and $500,000, up to 10 years in prison and fines of up to $25,000.
- Felony theft, first degree — For property valued over $500,000, up to 20 years in prison and fines of up to $25,000.
Note that in Pennsylvania, retail theft, such as shoplifting, is a separate crime with its own penalty scheme. Punishments are based on the value of the merchandise stolen, ranging from a summary offense if less than $150 in value to a third degree felony if in excess of $1,000.
Robbery is always a felony, with penalties based on the severity of the offense and the harm caused. Inflicting serious bodily injury is a first-degree felony, carrying up to 20 years in prison, especially if weapons were involved. Unarmed robbery can draw up to 10 years of incarceration.
