Swimming Pool Accident Causes and Liabilities

Nothing beats the summer heat quite like a refreshing dip in a swimming pool. Pools are attractive venues for relaxation, exercise, and family fun. However, they also present inherent dangers that can lead to serious injuries. How different types of accidents occur has a direct bearing on the ability of an injured person to seek appropriate compensation from the party who may be responsible.

The following are common swimming pool accidents and resulting injuries:

  • Slips and falls — The areas surrounding pools are often wet, making them prime locations for slipping and tripping. Falls on hard surfaces like concrete or tile can result in everything from minor bruises to broken bones, head injuries, and severe spinal damage. These accidents are also caused by obstacles left in walkways or a general failure to maintain the poolside surfaces.

  • Drowning and near-drowning — According to the Centers for Disease Control and Prevention (CDC), over 4,000 unintentional drowning deaths occur annually in the United States, 80 percent of them in residential pools. Young children are especially vulnerable. Near-drowning incidents also can be catastrophic, often causing permanent brain damage due to oxygen deprivation.

  • Diving accidents — A plunge into a shallow end can have devastating consequences. When a diver hits the pool bottom, they risk traumatic brain injuries and spinal cord damage that can lead to paralysis. These tragedies frequently occur due to a lack of clear depth markers, inadequate warning signs, or poorly maintained and unsafe diving boards.

  • Chemical exposure — The chemicals used to keep pool water sanitary can be harmful if not managed correctly. Over-chlorinated water can cause painful skin burns, eye irritation, and respiratory problems. Conversely, poorly treated water can become a breeding ground for bacteria and parasites, leading to ear infections, skin rashes, and gastrointestinal illnesses.

  • Entrapment — A swimmer, particularly a small child, can have a limb, hair, or even their entire body held by the powerful suction of a pool's drain or filtration system. These terrifying incidents can cause severe injuries and drowning. They are almost always preventable and happen because of faulty, broken, or missing drain covers.

Swimming pool injuries often stem from negligence, inadequate supervision or poor maintenance. Determining who is legally responsible depends on factors like where the injury occurred and the relationship between the victim and the property owner.

  • Homeowners have a legal duty to take reasonable steps to keep their pool safe for guests. This includes keeping walkways and decks free of tripping hazards and warning visitors about dangerous conditions like uneven pavement. Also, they should secure the pool area with a fence and a self-latching gate to prevent young children from wandering in unsupervised.

  • Businesses like hotels, gyms, and public recreation centers that operate pools owe a high duty of care to their patrons. They are expected to maintain consistently safe conditions, hire qualified and attentive lifeguards, post clear warning signs and maintain the water quality. Failure to uphold these standards can make them liable for any resulting harm.

  • Third-party service providers or manufacturers may also be at fault. A pool maintenance company could be liable if their improper servicing leads to an injury. If an accident is caused by a defective product, such as a malfunctioning drain cover, a faulty pump, or a defective chemical dispenser, the manufacturer or distributor of that product could be held liable.

If you or a family member has been hurt in a pool accident, an experienced personal injury attorney can analyze the facts of your case to determine if you have a valid claim for damages. An attorney can also gather evidence and hire experts to help establish fault and pursue the compensation you deserve.
